Your access to and use of Westlaw is subject to the terms of the agreement below ("User Agreement"). To accept the terms and conditions, to be bound by them and to gain access to Westlaw, please read the Agreement. If you agree with the terms of the User Agreement, select "I Agree" and then click on the "GO" button below to submit the User Agreement. If you do not agree with the terms of the User Agreement, select "I Don’t Agree" and you will not be provided access to Westlaw.
- Access to Westlaw®. This Agreement is entered into to allow the public library that subscribes to Westlaw ("Subscriber") to permit user ("User") to access and use Westlaw at Subscriber's location. Access to and use of Westlaw by Users who have not agreed to these terms and conditions is strictly prohibited. All access to and use of Westlaw by User will be governed by the terms and conditions of this User Agreement and the Westlaw Subscriber Agreement which is incorporated by the reference into this Agreement.
a. Grant. West grants User a non-exclusive, non-transferable, limited license to access, view and use data ("Data) made available on Westlaw at Subscriber's location. Westlaw consists of West-owned and third party databases, services and functions ("Features") which may change from time to time. Access to certain Features may be restricted. User is licensed to use Data solely in the regular course of legal and general research and related work. User may also create printouts of Data for personal use and for distribution to a third party if such third party agrees not to further distribute the printout(s).
b. Limitations. User may not copy, download, store, publish, transmit, transfer, sell or otherwise use the Data, or any portion of the Data, in any form or by any means, except (i) as expressly permitted by this Agreement or (ii) with West's prior written permission. User shall not sell, license or distribute Data (including printouts) to third parties or use Data as a component of or as a basis for any material offered for sale, license or distribution. Any remote access by User to Westlaw is strictly prohibited.
c. Limited Download and E-mail Functionality. Notwithstanding anything in paragraphs 2a and 2b above, User may be permitted to download and/or e-mail a limited number of prescribed Westlaw documents at no charge, provided that Subscriber's Agreement with West so allows. In the event such limited download and/or e-mail functionality is permitted, User will be required to provide certain
additional information prior to downloading and/or e-mailing. Any such downloaded Data must be downloaded to a storage device under User's exclusive control and User must delete such downloaded Data after completion of the research and related work for which it was downloaded. Retention of downloaded data in a permanent archival database is prohibited.
d. Rights in Data. Except for the license granted in this User Agreement, all right, title and interest in Data, in all languages, formats and media throughout the world, including all copyrights, are and will continue to be the exclusive property of West and other contributors of Data.
- Responsibility For Charges. Subscriber is responsible for all charges for User's access to and use of Westlaw.
- Term and Termination. This User Agreement becomes effective when User clicks on the "I Agree" button, and will continue in force when this telecommunications link for this session is terminated.
